An Illinois judge on Friday issued a temporary restraining order against nearly 800 plaintiffs to block enforcement of Illinois’ new gun control law.

The law, signed by Democratic Gov. J.B. Pritzker last week at the start of his second term as governor, limits the sale of high-capacity ammunition magazines, bans “switches” that allow semiautomatic firearms to fire automatically, and “expands capacity.” of the courts to prevent dangerous individuals from possessing firearms through firearms prohibition orders.

Adapters, known as adapters, that effectively turn semi-automatic firearms into automatic firearms are prohibited under federal firearms laws in most cases.

The settlement is limited to more than 800 Illinois residents who are plaintiffs in a lawsuit brought by former Illinois attorney general candidate Thomas DeVore. The plaintiffs argued that the ban violated the Illinois constitution.

Effingham County District Judge Joshua Morrison ruled that the bill violated the plaintiffs’ rights and ended the state’s ability to enforce the law against a particular group.

In his ruling, the judge said state officials had failed to comply with the procedural requirements required by the law to “withstand the strict scrutiny required when restricting rights to avoid demonstrable irreparable harm.” .

“This legislation used criteria to choose who could and could not own a gun,” Morrison said. “Furthermore, due to the speed with which this bill was passed, the impact on protected classes could not have been considered, and the legislature failed to consider whether it was the least restrictive means of achieving its goals.”

The office of Illinois Attorney General Kwame Raul, a Democrat, will file an appeal and ask the appeals court to vacate the temporary restraining order, Door said. – Speaker Jamie Dunn-Thomason in a statement following the decision.

Pritzker said Friday that he is confident the courts will uphold the law, regardless of the judge’s decision.

“This decision is not surprising. “While disappointing, this is the first result we’ve seen in many cases brought by plaintiffs seeking to advance a public safety ideology,” Pritzker said in a statement Friday.

“We are well aware that this is only the first step in protecting important legislation,” he continued. “I am confident that the courts will uphold the constitutionality of the Illinois law, which is consistent with eight other states with similar laws and was developed in consultation with legislators, attorneys and legal experts.”

The lawsuit is one of many filed soon after the new gun law took effect, which passed along party lines in the largely Democratic-controlled state legislature. ‘The state. One was filed by several gun rights groups in the Southern District of Illinois, and the other in Crawford County. Both are now awaiting trial.

On Wednesday, Pritzker challenged the lawsuit, telling CNN’s Kaitlan Collins he was confident the law would hold up in court because Illinois is the ninth US state to ban assault weapons.

“All there was was trouble with banning assault weapons from other states. We are, quite frankly, copying what has been done in other states. In fact, ours falls within the strictest yet constitutional and acceptable boundaries. A lot of scientists have said that about our law,” Pritzker said on “CNN This Morning.”

In recent months, Pritzker has approved additional gun restriction legislation in Illinois.

In May, Pritzker signed legislation that would ban individuals from selling or possessing “ghost guns,” or self-made firearms. It also ensures that all firearms are serialized so law enforcement can better track them.

In June, Pritzker signed another bill requiring the Department of Public Health to conduct a two-year public awareness campaign on safe firearm storage.
