On Friday, September 2, 2022, two San Rafael police officers were placed on paid administrative leave after body camera footage revealed they took a man to the ground and left him bleeding during a confrontation over an open container violation. The episode reportedly occurred on July 27, 2022, after officers Daisy Mazariegos and Brandon Nail saw a man with an open container of beer on Windward Way. After a public outcry against the brutal capture, an investigation has now been launched against the two officials involved in the incident. The victim was reportedly found not guilty.

The investigation is underway after questions about an open container of beer turned into a brutal takedown by San Rafael police, sending a man to the hospital and to court on multiple charges, including felony resisting arrest. Regardless, those charges have since been dropped and attention is being paid to the actions of Marin County police officers. The man’s attorney and industry experts told I-Team ABC7 reporter Dan Noyes that this should not have happened. They say those officers used excessive force and that something like one of them lied in his official report of the incident. Along the industrial section of San Rafael’s Windward Way under the power lines, simply past the Canal District Community Garden, workers reportedly gather after work to mingle, eat and drink.

On July 27, San Rafael Police Officer Daisy Mazariegos resisted three men who had been drinking on Windward Way. Among the men was a famous gardener from Marin County, who allegedly tried to explain that he and his companions routinely met in the neighborhood to drink beer and catch up on work. Accordingly, the Mazariegos official asked them to put down the beer before adding: You barely drink here, do you believe it’s fun? At that point, she asked each of the three men to produce valid identification.

Not long after, San Rafael Police Officer Brandon Nail showed up at the scene. The moment the gardener got up to dare reach into his pocket and pull out his ID, Clerk Brandon Nail asked him to throw himself down. Despite attempting to cooperate, the gardener was forced to stand up to reach for his ID when clerk Brandon Nail grabbed him and threw him to the ground, leaving the victim with a bloody face. Afterward, when San Rafael police officer Brandon Nail recounted the incident to a colleague, he claimed the victim tried to place him in the head.

Speaking about the episode, Charlie Dresow, the victim’s lawyer, said that they just grabbed the person, punched him and buried his face in the gravel, that’s not right. His face was bloodied and he suffered a broken nose and loss of consciousness. The victim was taken to a local hospital and later charged with felony resisting arrest. However, those charges were dropped and the focus is currently on the leadership of the San Rafael police.
